Minutes of the regular meeting of the Village of Nyack Board of Trustees held at 7:30pm

on Thursday, July 8th, 2010 at Village Hall, 9 North Broadway, Nyack NY

Adoption of Minutes:

Minutes for regular meeting of June 24, 2010 were approved as presented with a motion by Mayor Kavesh.  Motion seconded by Trustee Foster and passed with a unanimous vote.  Trustee Parker abstained due to absence.

 

Public Comment

            Bob Cummings (Clermont 1 Condos) – Barge/Nyack Marina

                Proposed removal of sunken barge in the Village Marina, to be coordinated with work being performed at

the Clermont. After discussion, the Board asked Mr. Cummings to research the cost of said work and report findings as soon as possible. The following persons also spoke on this matter: J. C. Brotherhood, Jerry Donnellan, Richard Gilbert.

                Peter Klose (River Rowing Association) – Nyack Marina usage

Discussion was had regarding the River Rowing Associations use of the Village Marina and its’ effect on other users. The Village Clerk provided some clarification of previous permission given to the Association – which was for storage of vessels and their limited usage for training exercises. After discussion, Mayor Kavesh moved to approve the continued usage of the Marina   Monday thru Friday from 9am-2pm, at which time the portable dock is to be removed. Workshop for further discussion was scheduled for 7/22/2010 @ 6:30pm.

 

The following persons signed up to speak during the public comment session:

-Dominic Olivier asked the board to approve expenditure of $900 for backboard replacement at Memorial Park basketball court. ‘Taz’ Memorial Basket ball tournament is this Sunday (7/11/2010). Mayor Kavesh moved, Trustee Foster seconded approval of the expenditure. The funds will come out of line 518 (Youth Recreation Misc.) Mr. Olivier will secure voucher from Village Administrator tomorrow. Motion was passed by unanimous vote.

 

Reports to the Board

Orangetown Police

Mayor Kavesh reported on community meeting held this past Saturday (7/3/2010) at the Nyack Senior Center. Trustee Foster was asked to attend the monthly police meeting on 7/13/2010 and to inquire as to procedure for establishing a ‘Neighborhood Watch’ group.

 

Village Administrator

        Bond Resolution-Capital improvement

The following amendments to various bond resolutions were presented :

1.       Moved by Trustee Foster, seconded by Trustee Laird-White - $320,000 Road Improvements

2.       Moved by Trustee Foster, seconded by Trustee Laird-White –   45,500 Park Improvements

3.       Moved by Trustee Laird-White, seconded by Trustee Foster –   40,000 Highway Vehicles

4.       Moved by Trustee Laird-White, seconded by Trustee Foster – 305,000 H. H. Parking lot

5.       Moved by Trustee Laird-White, seconded by Trustee Foster – 117,800 Drainage improvemts

6.       Moved by Trustee Laird-White, seconded by Trustee Foster – 170,000 Drainage improvemts

7.       Moved by Trustee Laird-White, seconded by Trustee Foster – 155,000 Parking lot drainage

8.       Moved by Trustee Laird-White, seconded by Trustee Parker –     45,000 Park improvemts

9.       Moved by Trustee Laird-White, seconded by Trustee Parker –     47,700 Drainage improvemts

10.    Moved by Trustee Parker, seconded by Trustee Laird-White -   135,000 Water Dept improvmt               

All motions were passed by unanimous vote.

 

Village Clerk

- Report given to board on Tax collection.

 

Public Hearing

8pm-To add a provision to the Code Village of Nyack to regulate the display of flags and pennants on municipal flagpoles.

 At 8pm, Mayor Kaveshmoved to open public hearing to add a provision to the Code Village of Nyack to regulate the display of flags and pennants on municipal flagpoles.  Tr. Foster seconded the motion which passed unanimously.

After discussion, at 8:13pm, Trustee Foster made a motion, Trustee Parker seconded motion to close the public hearing and it passed by unanimous vote. Dave Zornow and Luke Birkeland also commented on this matter.

Trustee Parker made a motion to approve proposed addition to the Village code as a “Type II” action under SEQRA. Trustee Laird-White seconded the motion and it passed unanimously. Correspondences from Adam Lipson and Planned Parenthood of Peconic, Inc., commenting on the issue, were read into the minutes and will remain part of the official record.

 

Committee Reports

Public Works & Building

-Proposal for Building Department software was deferred to the Administrator for review.

-Brief report on FEMA projects, etc. concerning the Nyack Marina. Trustee Knowlton moved to direct Village Engineer to submit proposal reports to Trupin Insurance Services (J. Trupin) and for review. Trustee Laird-White seconded the motion which passed unanimously.

Infrastructure

Economic Development

            - ‘Superblock’ feasibility study report

Information Technology

Residential

-Trustee Parker will respond to request from Toni Keys (Nyack Housing) regarding sidewalk repair at Depew Manor.

-Report on meeting this past Wednesday’s meeting with Bert Hughes and Geri Levy (RHAC)

Applications are now being accepted for the affordable housing at 207 Depew Ave.

Inter-Governmental Relations

            Trustee Laird-White gave a brief report on:

                        -certified Arborists for the Village

-Proposed community workshops with the Orangetown PD

-meeting with Nyack Plaza management on residents’ concerns

Parks & Recreation

 

Budget, Finance, and Administration

Mayor Kavesh asked the board to consider the following:

-agenda format changes/amendments

            -ideas on how to increase revenue in the budget

-reflect on ‘what we’ve done so far this year?’ and ‘what do we want to do for the second   half of the year?’

 

Old Business

Bus Shelter-

Village Clerk was directed to remove this item from the agenda

Sidewalks-

Next meeting will be discussion to consider going out to bid for sidewalk repairs

Home Rule (birth/death certificates)-

Mayor Kavesh moved, Trustee Laird-White seconded motion directing the Attorney to draft a resolution requesting State Assemblywoman, Ellen Jaffe to sponsor legislation on behalf of the Village of Nyack’s proposed increase of fees for birth and death certificates. Trustee Laird-White seconded the motion which passed unanimously.

 

Communication

-Tr. Parker made a motion to approve request form St. Francis of Assisi Parish Youth Group to offer their lunch program outside of Nyack Center on Saturdays (10/2/10-5/2011) from 12noon -1pm. Trustee Laird-White seconded the motion and it passed by unanimous vote.

- Request from Joseph Desmaret (HADF) requesting use of Riverspace lot for their annual Haitian Art Expo was approved by Mayor Kavesh with the following amendments:

     *date change to Sunday, August 8 (9am-6pm)

      *use of half of parking lot (theatre side), not entire lot

Trustee Laird-White seconded the motion and it passed unanimously.

-Mayor Kavesh moved to approve request from Darryl Handberry (Tappan Zee Lodge No. 79) to hold their “Keeping It Real” community outreach event on 7/31/2010 from 3pm-7pm. Approval includes closure of Depew Avenue (from Franklin St to 90 Depew Ave.) so as not to inconvenience residents of the Depew Manor complex. Trustee Parker seconded the motion and it passed unanimously.

 

New Business

            **The following person asked to speak during the additional public comment session:

-Luke Birkeland inquired as to how to be included in bid process for Village’s municipal financing. Village Administrator will discuss with him.

         

Executive Session

Personnel

At 10:10pm, Trustee Parker moved to go into executive session to discuss matter of personnel.  Trustee Foster seconded the motion, passed unanimously.       

At 10:30pm, Trustee Parker moved to come out of executive session. Trustee Laird-White seconded the motion which passed unanimously.

                   

Adjournment

There being no further business nor anyone present wishing to be heard, Trustee Parker moved to close the regular meeting.  Trustee Laird-White seconded the motion and it was passed unanimously at 10:32pm.
