Hazardous Road Conditions – General
The Nyack Village Board of Trustees, as the legislative body of an incorporated village in the State of New York, pursuant to Village Law 4-412, has jurisdiction over the public roadways within the Village of Nyack. Furthermore, the Nyack Village Board may, pursuant to Vehicle and Traffic Law 1640(18), and Village Code 330-55, declare a snow emergency based upon existing or forecasted weather conditions, and designate any roadway or portion thereof as a snow emergency route.
The purpose of this policy is to ensure the public safety and welfare during storm conditions which may cause the Village roads to become hazardous to automobile and pedestrian travel, and to ensure adequate passage and access for Emergency Service vehicles, including but not limited to Police, Fire, Ambulance and other providers.
In general, should snow, freezing rain or any other condition cause slick roads, the Superintendent of Public Works or his designee will be called. There does not have to be a measurable accumulation of snow or other material to request a Public Works department response, road conditions are the sole determinant. If a Village official or Orangetown Police Department member encounters slick or hazardous conditions, she or he is to advise the Superintendent of Public Works or his designee of the conditions and request a response from Public Works department. The Superintendent of Public Works or his designee will then direct a response depending upon the nature of the emergency.
SNOW EMERGENCY POLICY
In addition to the above, the below procedure is to be followed in the event of a snow accumulation of two inches or greater.
Snow Storm Warning Notification
If a snow storm advisory is projecting a snow fall of two inches (2’) or more, and an advisory has been issued by Rockland County Emergency Management, or other official state or federal notification systems, the Superintendent of Public Works is to be notified as soon as it begins to snow in order to allow him to direct an efficient response to the snow event.
Measurement of Snow Fall & SNOW EMERGENCY Implementation
The Superintendent of Public Works, or his designee, will check the depth of the snow accumulation at the Veterans Memorial Park on Main Street. He will first verify that there was no prior accumulation on the ground that will affect the measurements. Once verified, this information is to be entered into his daily log, noting locations. As snow then accumulates, measurements should be taken in three locations within the Park area, for example: the sidewalk, brick courtyard, on the top of the brick wall on the south side of the park. He should select those locations that are best unaffected by wind or blowing snow. Every time a measurement is taken, he shall enter the time and locations in his daily log.
Once two inches (2”) of snow has accumulated, it is deemed to be a snow emergency. The time and date is to be noted in the Superintendent of Public Works’ daily log. Upon notification by the Superintendent of Public Works that two inches (2”) of snowfall has accumulated, a recommendation to implement a Snow Emergency shall be made by the Superintendent of Public Works to the Mayor, or to the Senior Elected Official if the Mayor is out of the Village; the Village Administrator shall also be so advised. Upon recommendation by the Village Administrator and the Superintendent of Public Works, and after any necessary consultation as may be required, the Mayor of Senior Elected Official may declare the snow emergency.
The process of notification will begin as soon as possible after the official measurement of two inches (2”) of snow. The following notification systems will be used to make public notification of the Snow Emergency implementation:
- Village Board The Mayor and Village Trustees will be notified immediately by the Superintendent of Public Works or his designee of the time and date of the two inch (2”) accumulation and the declaration of the snow emergency may be made by the Mayor. In the Mayor’s absence from the Village, the Senior Elected Official present at that time will make the declaration.
- Village Hotline Message The message will state the time of the Snow Emergency, with date and official time as noted by the Superintendent of Public Work or his designee.
- Web site notification. An official notification of the date and official time the Snow Emergency was implemented will be stared on the Village’s official web site.
- Radio Notifications. Appendix #1
- Emergency Alert System. We will provide information which will be disseminated to the public by our Village alert system provider that can reach phone numbers, pagers, e-alerts, etc. This information will provide the time of the start of the Snow Emergency and lifting of the Snow Emergency. Please note that notifications will be sent out for both implementation and the lifting of the Snow Emergency.
SNOW EMERGENCY Parking Restrictions
Upon the official announcement that a Snow Emergency has been declared in the Village of Nyack, the following Village streets will become no parking zones under special parking restrictions as referenced in Village Code Section 330-55 until the Snow Emergency has been lifted:

Off Street Parking Availability
Off street parking will be made available free of charge during the Snow Emergency time frame in all municipally owned parking lots (Artopee, Riverspace, Catherine Street, Spear Street, Marina, and Memorial Park lots). Vehicles must be removed within 12 hours of the lifting of the Snow Emergency.
“No Parking” Enforcement
The Snow Emergency Policy outlines those streets (listed above) as “No Parking” under a special parking restriction effective during a Snow Emergency Declaration. Every person convicted of a violation of the special parking restrictions contained in the Snow Emergency Policy shall be subject to the penalties set forth in Village Code Section 330-57, to the extent that a first conviction shall be punished by a fine of not more than $50; a second conviction by a fine of not more than $100; and upon a third conviction by a fine not more than $250. Additionally, all vehicles violating the special parking restriction contained in the Snow Emergency Policy may be towed at the expense of the owner.
The Village of Nyack Department of Public Works is directed to post traffic control devices, consisting of signs containing notice of the special parking restrictions contained in the Snow Emergency Policy, on the streets referenced herein.
End of Snow Emergency
The prohibition of parking on the streets listed in this policy will remain in effect until snow fall has ceased and all streets are cleared of snow as determined by the Superintendent of Public Works or his designee.
The date and time of the lifting of the Snow Emergency will be noted by the Superintendent of Public works or his designee in his daily log.
The process of notification that the Snow Emergency has been lifted will follow the same protocol as the Snow Emergency Implementation listed above.
