APPLICATION INSTRUCTIONS
(See additional requirements when applying to land use Boards)
- In making this application, submit the following:
- One (1) copy of this form.
- Two (2) set of building plans.
- Two (2) copies of the plot plans.
- Copy of Rockland County licenses. (For each trade)
- Certificate of Workman’s Compensation and Disability Benefits Insurance or Owner’s affidavit. (For each trade)
- Plot plans drawn to scale, shall show area, dimension, and location of lot; size and exact location of proposed structures, additions or alterations; all existing structures , all existing structures on lot; streets, curbs, sidewalks, parking spaces driveway; yards and setback; and such other information as may be necessary.
- Building Plans drawn to scale shall show structural details, floor plans, elevation, plumbing, electrical, heating and ventilation details.
- The NY.S. Department of Education Law states that a building permit may not be issued for any commercial structure or for a residence containing more than 1500 square feet of habitable space unless the building plans are prepared and signed by a New York State licensed engineer or registered architect.
- No building permit of Certificate of Occupancy shall be issued by the Building Inspector unless all provisions of the Village of Nyack Zoning Code and the New York State Uniform Fire Prevention and Building Code are in compliance
- Fees are based on cost of construction. (This office reserves the right to adjust any fee prior to issuing the Certificate of Occupancy if it is shown that the original fee
was not sufficient to cover the actual cost.) Bills, invoices and other documentation must be submitted to substantiate both the Estimated Cost of Construction,
as well as the Actual Cost of Construction.
- Mandatory inspections are required for issuance of Certificate of Occupancy.
- Underground utilities are required by the Zoning Code.
- It shall be unlawful to use or permit the use of any building or premises or part thereof, hereafter created, erected, changed, converted or enlarged wholly or partly,
in its use or structure, until a Certificate of Occupancy shall have been issued
- This office reserves the right to require that the affidavit of compliance on the application for a Certificate of Occupancy be submitted and signed by the architect or engineer of record.
- The building permit expires two years from the dare of issuance. One six (6) month extension may be granted prior to be expiration date of the building permit (Renewal of all expired building permits requires a new application and fee.)
NO WORK IS TO BE STARTED UNTIL A BUILDING PERMIT HAS BEEN ISSUED
Mandatory Inspections of Construction
You MUST schedule inspections prior to concealing affected areas
Other inspections will be made in some cases, but those listed below must be made or the Certificate of Occupancy may be withheld. Do not mistake an unscheduled inspection for one of those listed below.
Unless a card is left on the job indicating approval of one of these inspections, it has not been approved
and it is therefore improper to continue beyond that point of work. Any disapproved work must be
re-inspected after the correction.
Call ahead for all inspections:
- Erosion Control: Silt fence and tree protection.
- Footing Forms: When excavation is complete and forms are in place (before pouring) Rebar in
place and hooked at all corners.
- Foundation: Check for waterproofing, type of block, footing drains, insulation as needed.
- Plumbing: Under Slab: Cast iron, copper, etc.
- Gravel Under Slab: (Usually combined with (#3). Check for insulation as per Energy Code.
- Plumbing Rough In: All work that will be covered (enclosed) must be installed at this time.
- HVAC Rough In: All work that will be covered must be installed at this time.
- Framing: Call when frame is complete including fire-stop, bridging, collar ties, etc. before it is covered from the inside with insulation.
- Insulation:
- Plumbing Final: This can be combined with final. All fixtures to be installed at this time.
- In Garage and where ever appropriate: Fire rated sheetrock to be inspected before painting.
- Rough Grading: All surface water should be directed away from the building to an approved outlet, street, lawn, inlet, drainage swale, etc. This can be combined with final.
- Final: Complete application for certificate of Occupancy, produce certified plot plan or as-built survey including outlet for footing drains to positive outflow. Provide Fire Underwriters Certificate. Building must be essentially complete with all utilities working.
If Demolition Permit – Please submit the following:
The following items must be presented to the municipality before demolition can occur:
- Asbestos abatement survey by a licensed practitioner.
- Letters from utility companies that the gas, electric and water have been turned off.
- Affidavit that the premise has been baited for rodents and vermin.
- Approval from the Department of Environmental Management & Engineering for Sealing of Sewer line.

Application for a Temporary Banner

BANNER SPECIFICATIONS: The banner will be made of non-combustible, opaque material that will not shred. Banners must be two sided. Banners must have eyelets installed across the top and the bottom in a fortified border at two foot intervals, and at the corners. Banners must have half-circle vent holes (6 inch diameter minimum) and must have 1 vent hole per 4 square feet of banner. 4 tie ropes of the appropriate length (see below) must be provided. Banner maker may not advertize on banner.
BANNER SIZES: Width Height Tie Rope Length
LARGE: 30 FEET 40 INCHES 8 FEET (4 ropes)
SMALL: 24 FEET 30 INCHES 12 FEET (4 ropes)
Ten (10) copies of the application & revised drawings must be submitted.
THE FOLLOWING MUST BE ATTACHED TO THE APPLICATION:
1. Two (2) copies of the application.
2. Two (2) copies of the drawing of banner, indicating materials, color, size of lettering and/or pictorial matter, total sign area, anchorages and hanging devices, and any pertinent information.
3. Copy of Certificate of Insurance as filed in the Clerk’s Office.
4. Banner must be dropped off at Village of Nyack Department of Public Works 63 Catherine Street, Nyack, New York 10960 two days prior to the date the banner is to be installed and picked up within 24 hours after taken down. The Village will not be held responsible for banners not picked up within that time, and will not provide storage or tracking of banners.
PERMISSION FROM THE BOARD OF TRUSTEES
Temporary Banner Permits are issued only to Nyack not-for-profit organizations announcing Nyack-based activities. Organizations seeking a permit to string or suspend temporary banners across any street or thoroughfare within the Village of Nyack, must first obtain permission from the Board of Trustees of the Village. The Board meets every second (2nd) and fourth (4th) Thursday of the month, subject to change for holidays and summer scheduling.
The completed request form must be returned to the Village Clerk before noon on the Friday prior to a scheduled meeting of the Board of Trustees. This will serve as notification that the applicant wishes to be placed on the agenda. The applicant must appear before the Board to request permission to hang a temporary banner.
Following approval by the Board of Trustees, the applicant must provide the required Certificate of Insurance to the Village Clerk, who will sign the completed request form and return it to the applicant.
REVIEW BY THE BUILDING INSPECTOR
The applicant will then submit the completed Application for Temporary Banner Permit, with all required documentation, to the Building Inspector for his review. (The application form is printed on reverse side of the request form). A fee of $ 225.00 is due at the time of submission of application.

PERMIT ISSUANCE
The building inspector will issue a permit within five (5) calendar days of receipt of the Village Board’s decision, or within five (5) calendar days or receipt of the completed Application for Temporary Banner Permit if no Architectural Review Board appearance is required.

EXECUTIVE SUMMARY
The Village of Nyack (Village) is located in the Towns of Orangetown and Clarkstown in Rockland County, serves approximately 6,800 residents, and encompasses approximately one square mile. The Village provides various services to its residents, including street maintenance, snow removal, street lighting, and general government support. These services are fi nanced primarily with real property taxes and State aid. General fund expenditures totaled approximately $5.3 million for the 2010-11 fiscal year.
The Village is governed by the Village Board (Board), which is comprised of four elected council members and the elected Mayor. The Board is the legislative body responsible for the general management and control of the Village’s fi nancial affairs. The Board also determines policy and appropriates funds for various governmental functions and services. In 2010 the Village created the
position of Village Administrator who serves as the chief operating officer and is responsible for the day-to-day management of the Village. The Nyack Center (Center) serves the Village along with the larger community of Rockland County. It provides services to the community such as a breakfast club for students, an afterschool program, a substance-free performance program for teenagers, a teen dropin center with available computers and tutors, youth-organized groups with adult advisors, an out-ofschool suspension site program, youth workshops, and a monthly family game night. Since 2008, the Center also has provided a six-week children’s summer camp program (camp).
Scope and Objective
The objective of our audit was to review the monitoring of the Center’s funding and the Village’s purchasing practices and claims processing for the period June 1, 2010, to July 31, 2011. We extended our scope period for the monitoring of the Center to January 2008. Our audit addressed the following related questions:
• Did the Board suffi ciently monitor the Center’s activities to ensure that Village funds were
expended in the best interest of Village taxpayers?
• Did Village offi cials ensure that purchases were made in accordance with the Village’s
purchasing policy and that desired professional services were obtained at the most favorable
terms and in the best interest of taxpayers?
• Did the Board properly review claims to ensure that they are accurate, valid, and for legitimate
Village expenses?
