Nyack Planning Board—October 3, 2011

Called the meeting to order at approximately 7:40 p.m.

 

1. 42 Main Street. Dan Koplowitz. Continuation of site plan application to finalize site drainage requirements. Comments from Village Engineer included.

 

Applicant represented by Dan Koplowitz. Memo dated 9/25/11 from Village Engineer was discussed. Assumption was 42 Main would connect to storm drain in front of building, but as construction began it was determined that there was not a storm drain in front of 42 Main St. Proposal is to allow existing storm water design to remain but Applicant must retain an engineer to sign off on calculations.

 

Applicant – Stated he tried to get an engineer to come down and no one came and that all an engineer will do is confirm the existing calculations, not verify that tapping into the storm drain is not necessary. An Estimate for $28,500 was submitted from contractor to pipe into existing system. Initial calculations called for 4inches per rain/hour, and now NYS wants 7 inches/hour.

 

Peter Voletsky – It’s not appropriate for the Planning Board to act as engineers and speculate what will work as far as a run off system.

 

Walter Sevastian – part of the Streetscape project will be the paving on Main this fall. Suggests that the applicant attempt to work with Village Administrator before the street gets paved in front of 42 Main.

 

It was Recommended that the Applicant call and engage an independent engineering firm to analyze calculations.

 

Applicant will return at a later meeting to continue this application.

 

2. 32 Tallman Avenue. Peter Vermazen. Site plan application to construct retaining wall. Conditional approval granted by ARB for aesthetic appearance. Several structural details inadequate, such as: footing depth, connection of new wall to old, wall design, drainage. Currently awaiting comments from Village Engineer.

 

Don Yacopino – Need an engineer to decide if the wall will hold rise in grade. Request is for an Engineer’s stamp on it. Also needs to address what will happen with downhill water. Recommendation is to get engineer’s stamp so it can be sent back to the Village Engineer for review.

3. 267 Main Street. Loren Bloom. Site plan application to erect a damaged retaining wall.

 

Approval granted by ARB. Original design and engineering information submitted to Village Engineer for comment. Proposal has been revised, submitted and forwarded to Village Engineer on 9/27/2011. Village Engineer has not yet responded

 

Bill Truss representing applicant – Loren Bloom. – Site application to erect a damaged retaining wall.

 

Responding to Village Engineer’s notes dated 9/30/11. 6 points were noted for comment.

 

Situation is that retaining wall is Mr. Bloom’s (on his property) but the wall may have come down due to poor maintenance of property owner to the west.

 

Public comment – None

 

Motion to close public by Chairman Klose. Second by Member Hammond. Passed 5-0

 

Motion by Chairman Klose to accept S1 and S2 drawings drawn on 8/12/11 and rev 10/3/11 which incorporate village engineer recommendations from letter dated 9/29/11, and to accept plans as drawn subject to reasonable concerns by Bldg department. Second by member Jean-Gilles. Passed 5-0

 

4. 189 Sickles Avenue. Ryan Davan. Application removal of two trees. Certified arborist’s report included.

 

Ryan Davan – 1 tree close to house leaving sap on house. Other tree is in need of removal too.

 

Public comment – none, motion to close by Member Voletsky – second by Member Hammond. Passed 5-0

 

Remediation – will be to put back 1 tree 1″-2″ caliper. Motion by Member Voletsky to allow applicant remove 2 trees and replace with 1 tree of 1″-2″ caliper. Second by Member Hammond. Passed 5-0.

 

Other Business:

 

A motion was made by Chairman Klose, seconded by Member Voletsky, to accept the September Minutes. Passed 5-0.
